Building managers that run a condo on New York’s pricey Upper East Side are suing an octogenarian resident for allegedly defecating in the luxury building’s communal swimming pool.
Lawyers from the Rio Condominium and Spa on East 65th Street, acting on behalf of the building’s management company, Allied Partners, allege 83-year-old Helen Hirsh ‘defecated in the Fitness Center’s pool and then again in the Fitness Center shower.’
They also allege in that she was swimming in the wrong communal lane.
‘The Condominium was forced to shut down the Fitness Center’s pool so that it could be properly sanitized according to the applicable State health code, and to the applicable State health code, and to take the Fitness Center’s shower out of use so that it could be cleaned and disinfected. As a result, other unit owners and residents were unable to use the pool or the shower during those times,’ the complaint reads.

The suit also goes on to make other claims about Hirsh’s alleged behavior, including how she ‘screams and makes loud noises while using the gym and the pool’ and has ‘failed on numerous occasions to wear proper attire in the gym (using the gym equipment in a wet bathing suit and not wearing proper athletic footwear) [or] to shower before using the pool.’
Following Hirsh’s alleged antics, the building’s board suspended her access to the basement leisure facilities, but the senior คอนโด citizen was able to make her way back in after ‘deceitfully obtaining a code to access the Fitness Center from a real estate broker’ who had been showing potential buyers around, according to the lawsuit.
On separate occasion she also allegedly ‘forced her way into the Fitness Center when another resident was exiting through the Fitness Center door.’

The building claim the police were almost called after staff attempted to block Hirsh from getting back into the fitness center.
Hirsh, who used to be a doctor, says that most of the allegations are untrue and is planner to countersue – even suggesting that she doesn’t know how to swim properly.
‘Tomorrow, I go to court to sue them,‘ Hirsh said. ‘I want to sue the management company!’
‘I always swim near the wall, you know. I am scared,’ she told the explaining that after breaking her leg, her doctor prescribed daily workouts in the building’s pool for exercise.
But, she says, she is not a good swimmer. ‘I don’t know how to swim. I am not very good,’ Hirsh said.

She also denies ever pooping in the water.
‘No, never. Maybe I am getting old. Do they have evidence? Ridiculous, I was a doctor before!’ she exclaimed.
‘Listen, listen, I tell you…this is ridiculous; I don’t want to live here anymore.’
Hirsh, who only moved into her one bedroom, one bathroom apartment in the building last year, says the problems began after she failed to tip the building staff.
‘I’m an old lady. Why should I tip you all the time?’
She believes that management want her out of her place
The lawsuit is suing Hirsh for monetary damages, although no amount is stipulated in the court documents.
One-bedroom apartments currently sell for more than $1 million in the 37 story building.
The listings detail how residents are able to take advantage of the building’s ‘pool, sauna, gym, and roof deck which is located on the Upper East Side in the fashionable 60’s near transportation, restaurants and shopping.’
